Preamble to the Constitution of India : An Integral Part
Preamble is the beginning of the Constitution of India giving an insight or brief summary about the Constitution.
The objective resolution proposed by Pandit Nehru ultimately became the preamble. Preamble and Constitution were drafted in the light and direction of the objective resolution adopted by the constituent assembly on 27th January, 1947.
Amendment to the Preamble
The question of whether the Preamble can be amended under Article 368 of the Constitution of India for the first time in the landmark case of Kesavananda Bharti v. State of Kerala (1973). It was contended that the preamble can not be amended as it is not a part of the Constitution. But the Supreme Court recognised the importance of the Preamble and held it to be an integral part of the Indian Constitution. In 1976 preamble was amended for the first time by the 42nd Constitutional Amendment Act, it added three new words to the preamble which are :
- Socialist
- Secular
- Integrity
Preamble serves several important purposes :
- It indicates the source from which the constitution comes.
- It contains the enacting laws which bring into force the Constitution.
- It contains the ideals and philosophy of the Constitution.
- It explains the purposes and objectives with which the document has been written.
- It declares great rights and freedom for the people of India.
- Talks about the structure of governance.
The Preamble is considered to be the key to the Constitution of India.
