Babri Masjid Demolition Case : All the accused Acquitted by CBI
Nearly three decades after the demolition of Babri Masjid, the court has announced its verdict. Investigating number of witnesses, examination of documents, TV footage and photos lead to framing charges against 49 people including certain leaders from the then opposition party BJP.
All the acts were deemed to be pre-planned. Last year the Supreme Court said that the demolition of the mosque was a ‘calculated act’ and an ‘egregious violation of law’.
Special CBI Court in Lucknow, today pronounced its judgement in Babri Masjid demolition case. All the 32 accused were asked to be present in the court. Security around the court was tightened, before the hearing. However, only 26 accused reached the CBI court for the verdict, and the rest were connected through video conferencing.
All the 32 accused were acquitted by the Special CBI Court in Lucknow after 28 years of the Babri Masjid demolition. All the charges from obstructing a civil servant from discharging it’s duty to criminal conspiracy was rejected by the court in its 2300 page verdict.
Special Judge SK Yadav said that the demolition of the mosque was not pre-planned rather the BJP founder members – LK Advani and Manohar Joshi tried to stop the act through ‘anti-social elements’. He further added that there was no conspiracy in the act and it happened at the spur of the moment.
CBI had no evidence as to the objectionable slogans which were raised during the time of demolition, the voices of the accused were not recognised and also the evidence provided by the CBI were not sealed.
On the issue regarding the imposition of Section 144 of CrPC which prohibits the assembly of four or more than four people in that area. The court is of the view that at the time the section was imposed there were many people, so the accused were not aware of the same.
Last year, in the judgement of Construction of a temple or a mosque, Supreme Court allotted the disputed land in Ayodhya for the construction of Ram Temple. However, it clearly mentioned that the demolition of Babri Masjid in 1992 was against the law. It also found an alternative five-acre site in the city for the construction of a mosque.
